1. General Provisions & Identity
These Terms of Service govern the use of Cultiv'Up, a web application owned and operated by
Pecquereau SRL, a Belgian company with its registered office in Velaines, registered under
BCE number 0555923331.
By creating an account, you agree to these terms. Cultiv'Up is a tool designed to assist in
agricultural management; however, the user remains solely responsible for their legal
obligations.
2. Services & "As-Is" Disclaimer
Cultiv'Up provides features for field management, crop tracking, stock monitoring, and
operation recording.

Legal Guarantee:
While the app allows
for data export for government controls, Pecquereau SRL does not guarantee that
these exports meet the ever-changing legal requirements of Belgian or EU
authorities.

The
"As-Is" Clause:
The service is
provided on an "as-is" and "as-available" basis. We do not warrant that the app will
be error-free or uninterrupted.
3. Subscription & Payment (Stripe)
Our payment process is securely conducted by Stripe.

Merchant of Record:
PECQUEREAU SRL is the
Merchant of Record for all our orders. Payment processing services are provided by
Stripe.

Trial
Period:
We offer a 30-day
free trial managed internally. No payment details are required for the trial. Upon
expiration, access to premium features will be restricted unless a subscription is
purchased via Stripe.
4. Right of Withdrawal & Refunds (Belgian Law)
In accordance with Belgian and EU consumer law:

Digital
Content:
By subscribing and
requesting immediate access to the service, you acknowledge that you waive your
14-day right of withdrawal once the digital content delivery has begun.

Refunds:
Since we provide a
30-day free trial to evaluate the software's fitness for your needs, payments made
via Stripe are generally non-refundable except in cases of technical failure on our
part that prevents service use.
5. Limitation of Liability (The "Protection" Clause)
To the maximum extent permitted by Belgian law, Pecquereau SRL shall not be held liable for:

Data
Accuracy:
Any errors in stock
levels, fertilizer calculations, or pesticide applications entered by the
user.

Regulatory Penalties:
Any fines, sanctions,
or legal issues the user faces during government inspections. The user is
responsible for verifying the accuracy of exported data before submission to
authorities.

Financial Loss:
Indirect damages,
loss of crops, loss of profits, or business interruption.

Total
Cap:
In any event, our
total liability shall not exceed the amount paid by the user for the service in the
12 months preceding the claim.
6. Data Responsibility & Hosting

Ownership:
You retain all rights
to your data.

Hosting:
Data is stored via
Firebase/Google Cloud Firestore. While we use industry-standard security, we are not
liable for third-party hosting outages or data breaches beyond our reasonable
control.
7. User Obligations
You agree not to:
- Use the app for any illegal purposes.
- Attempt to reverse-engineer the webapp.
- Input false data intended to deceive regulatory
bodies.
8. Termination
We reserve the right to suspend accounts that violate these terms or fail to pay. Upon
termination, you will have 30 days to export your data before it is permanently deleted from
our Firestore database.
9. Governing Law
These terms are governed by Belgian Law. Any disputes shall be subject to the exclusive
jurisdiction of the courts of Tournai.

1. Compliance & Legal Basis
We process personal data in accordance with the EU General Data Protection Regulation (GDPR)
and the Belgian Data Protection Act.

Information:
Name, email
address, and farm identification (if provided).

Agricultural Records:
Field coordinates,
crop types, fertilizer/pesticide usage, and stock levels.

Data:
Logs of when
operations were recorded.

Payment
Data:
We use Stripe for
payments. Pecquereau SRL never stores your credit card or bank details. Stripe
collects this data independently as a separate Data Controller.
3. Sub-Processors (Where your data goes)
To provide Cultiv'Up, we share data with the following essential providers:

Google
Cloud / Firebase:
Our database
(Firestore) is hosted on Google servers. We select EU-based data centers (e.g.,
Belgium or St. Ghislain) to ensure data stays within the EEA.

Stripe:
Our payment
processor. They process your subscription data and handle payment compliance.
4. Data Security & "No Manual Backup"

Storage:
Your data is stored
securely in Firestore.

User
Responsibility:
Cultiv'Up does not
currently offer a "one-click" manual backup or local export feature for the entire
database. You acknowledge that it is your responsibility to manually record or print
critical reports from the screen if you require physical copies for your
archives.

Liability:
Pecquereau SRL is
not liable for data loss resulting from server outages or account
termination.
5. Your GDPR Rights
As a European user, you have the following rights:

Access:
Request a copy of
the data we hold about you.

Rectification:
Correct any
mistakes in your records.

Erasure:
Request that we
delete your account and all associated data (subject to tax record retention
laws).

Data
Portability:
Request an export
of
your operational data in a machine-readable format.

6. Data Retention
If your trial expires and no subscription is started, or if your subscription is canceled,
Pecquereau SRL reserves the right to delete all user data after 30 days of inactivity to
minimize data storage risks.
7. Google Sign-In & API User Data
When you use Google Sign-In to authenticate, we receive your basic profile information (such
as your name and profile picture) and your email address. This information is used strictly
to verify your identity, create your account, manage your access to Cultiv'Up, and contact
you regarding your account.
Cultiv'Up's use and transfer to any other app
of information received from Google APIs will adhere to the
Google API Services User Data
Policy,
including the Limited Use
requirements.

Explicit Consent & Usage:
We do not sell,
share, or misuse your Google authentication data. Furthermore, your data is never
used to develop, improve, or train generalized AI or ML models. It is securely
stored in our database for login purposes only.
